Parental Responsibility - Decision-making and Parenting Time
Parental responsibilities include parental decision-making responsibilities (formerly known as "custody") and parenting time (formerly known as "visitation"). Our goal is to obtain a negotiated agreement between the parents that will be acceptable to both of them, and that will be in the best interests of the children; however, when that is not obtainable, we vigorously advocate our clients' position. We often find that, many times, modification of the original decision-making and parenting time allocations needs to be addressed post-decree, due to changing circumstances (such as the children getting older and wanting to be involved in activities that would be negatively impacted by the current arrangement), or because one parent is not providing adequate care for or supervision of the children. Also, not infrequently, one parent may want to relocate within Colorado or even to another state with the child (called relocation), and the move will significantly impact the parenting time of the other parent. All of these situations need to be addressed promptly, professionally, and competently. Our firm will do that for you.
Grandparent's/Third-Party Rights and Visitation
Many of our clients are grandparents who have (or want to establish) a relationship with their grandchildren, or who are other third parties who have special relationships with the children, but who are being denied contact with them by parents who are not living together as husband and wife. These clients need to establish their own right to have regular contact with the children, contact that cannot be denied them or that is contingent upon the whim of the children's parents. We believe that such contact is important to the children and must be preserved and guaranteed. Our firm will work with you to achieve this result.
Adoption
We also provide services to individuals seeking to adopt a child, often a step-parent who has developed a loving relationship with a child whose biological parent cannot or will not continue a parental relationship with the child. Child Support
Colorado law provides guidelines that determine whether and how much a parent pays child support for his or her child. The state child support guidelines use a formula and other factors to establish the amount of child support to be paid by one parent to the other. However, under certain circumstances, that figure may be adjusted upwards or downwards. Colorado law also provides an effective and relatively quick procedure to collect child support from a parent who is not paying even though court ordered to do so.
