Parenting Time and Decision-Making
At Peterson & Lyons, Attorneys at Law, PLLC, in Fort Collins, Colorado, our family law attorneys have extensive experience representing clients in cases involving parents and children. These cases can be the most contentious and acrimonious of all types of litigation.
Based upon our experience, and our education by and assistance from child specialists, we are able to pursue the best and most effective ways of helping parents achieve their goals, protect their interests, and insure their continuing relationship with their children. We strive to help our clients decide on a course of action that is truly in the best interests of their children. That often helps clients calm down and become more focused and at ease with the process and, hopefully, minimizes the situations that would result in the children being put in the middle of a fight between their parents. Whether it is an initial dissolution of marriage case, a modification of an existing divorce judgment, or it is a situation that has arisen because a parent is considering relocating with his or her child, we have the desire and experience to help you meet and successfully resolve the situation you find yourself in, whether such resolution occurs in our out of court. Parental Responsibility: Child Custody and Visitation
Parental responsibilities include parental decision-making responsibilities (formerly known as "custody") and parenting time (formerly known as "visitation"). Clients often confuse these concepts, which are related but distinct issues. The decisions regarding parental responsibilities hinge on a number of statutory factors, all of which focus on the best interests of the children. Sometimes parents want to set up parenting time with a different purpose in mind, such avoiding or minimizing the obligation to pay child support. Our courts, however, reject these efforts and try to set up schedules that maximize positive contacts with parents and minimize unfavorable contact. Only then, when parenting time is established in the best interests of the children, does the court consider the effect of that parenting time on child support.
If you have questions about a dispute involving the allocation of parental responsibilities between you and your child's other parent, contact a family law attorney at Peterson & Lyons, Attorneys at Law, PLLC.
